The donkey whose name half of Georgia knew by the end of summer is now the subject of a federal civil-rights lawsuit. On September 11, 2026, Hannah Michelle Israel filed suit against Cedartown Police Officer Trenton Ryan Garner in the Northern District of Georgia, Rome Division — Case 4:26-cv-00270-WMR. The claim: during the August search for a missing girl, Garner entered the family’s fenced pasture without a warrant and fired on HeeHaw, the one-year-old miniature donkey who had become the family’s unlikely internet star.

The donkey the internet watched grow up

HeeHaw wasn’t just livestock. The family bottle-fed him in the kitchen when he was a foal, and he repaid them by refusing to leave their side. Viral clips showed him trailing the family around the property, and one widely shared video captured him standing at the fence with a yellow DeWalt drill tucked under him like he was on the job. A million people watched a donkey act like a farm dog. That is the animal the officer is accused of firing on.

What the complaint actually says

The federal complaint lays out four counts under Section 1983, the civil statute for constitutional violations: unlawful entry, unlawful search, unlawful seizure, and destruction of property. Garner is sued in his individual capacity — not the department, not the city. A jury demand is attached, and the complaint names no dollar amount; compensatory and punitive damages are to be determined at trial.

That detail matters because of the number floating around the coverage. The $1,000,000 figure reported by WSB-TV is the family attorney’s separate pre-suit demand against the City of Cedartown. The complaint itself — the document actually filed in court — claims no specific amount.

The locked-gate problem

The complaint’s central fact is physical, and it may end up being the case’s spine: two locked gates stood between the public road and that pasture. The filing asks the obvious question — how does an officer end up inside a locked pasture, gun drawn, over a donkey? Who unlocked those gates, and under what authority? The family’s lawyers want answers under oath. A warrantless entry into a fenced pasture during a missing-person search is the kind of fact pattern that Fourth Amendment litigation was built for.

Garner’s account — and the report behind it

The released incident report describes a single round fired after a Taser failed, during a search for a missing girl. The family disputes that the situation ever justified it, and the viral response suggests a lot of people agree with them. Garner has been placed on administrative leave. The Georgia Department of Agriculture Law Enforcement Division is handling the outside investigation — a notable choice, handing it away from local command — and as of September 15, no criminal charges have been filed.

What happens next

Garner will file an answer or a motion, discovery will open, and the locked-gate question will get deposed out of everyone involved. The jury demand means this is headed toward a civil trial if it doesn’t settle first. The administrative and criminal tracks remain open and unresolved.
