Oakland Police Pilots Mart And Mac Indicted In Fake Flight Test Scheme

Oakland Police Pilots Mart And Mac Indicted In Fake Flight Test Scheme

Two Oakland Police helicopter pilots and the former FAA aviation safety inspector who was supposed to test them are charged in a seven-count federal indictment — and the scheme at the center of it wasn’t gunrunning or contraband. It was paperwork. Prosecutors say at least four checkrides, the practical flight tests required to certify pilots, never happened. The test forms claimed they did.

Officer Brandon Mart received three fraudulent certifications. Officer David Mac received one. Both were flying the city’s helicopter at the time of the alleged scheme. All three defendants pleaded not guilty in federal court in Oakland on September 10, 2026.

What a checkride is, and why faking one is a crime

A checkride is the final exam of aviation: an examiner rides along while a pilot demonstrates the maneuvers that standards require, and signs paperwork that says the pilot is qualified. It is the one moment where the FAA’s system depends entirely on the honesty of the examiner, because there is no second witness, no video requirement, and no re-test unless someone asks questions later. The examiner signs, the certificate issues, and the pilot is legal. When that signature is honest, the system works. When it isn’t, the fraud is invisible until something goes wrong in the air — or until a grand jury starts pulling the file apart.

That is what makes the indictment unusual. William Miller was an FAA aviation safety inspector authorized to conduct those tests — the exact person the system positions as its backstop. According to prosecutors, between July 2023 and March 2024, test forms were filed for checkrides that never took place at the Oakland airport, with false information entered on federal forms. Mart walked away with three certifications he never earned in the air. Mac walked away with one.

The pilots, and the helicopter they flew

Both officers are OPD veterans, each with the department since 2015, and both were assigned to the air unit at the time of the alleged crimes. The unit flies twin MD-500E helicopters over Oakland — the aircraft that circles schools, pursuits and downtown streets, feeding live video to commanders on the ground. A helicopter is only as trustworthy as the pilot’s certifications, and prosecutors say the paperwork behind those certifications was fiction.

The unit itself has been part of Oakland policing since 1971, and its aircraft carry a name that aged badly this week: ARGUS, a nod to the hundred-eyed watchman of Greek myth, painted across hardware that spends its nights orbiting the city. The tail numbers on those helicopters are public record, and they appear in flight-tracking logs residents check the way earlier generations scanned the police scanner. Those logs are about to be read differently. Every hour of flight time recorded by the unit now traces back to certification paperwork that a federal grand jury says was fabricated — and every defense attorney holding aerial footage from an OPD helicopter has a new line of questioning.

Mart’s exposure is the widest. Beyond the conspiracy and false-document counts, he is charged with obstruction for allegedly altering flight records after the fact — a count that carries up to 20 years. Mac is charged with conspiracy and a single count carrying up to five years. Miller, the former inspector, faces the counts tied to the false testing itself. Not one of them has been convicted of anything: an indictment is a set of accusations, and all three men say they are not guilty.

The timing nobody at OPD wanted

The indictment landed weeks before a federal hearing on whether Oakland should finally exit more than two decades of court oversight — oversight that has run continuously since the Riders scandal exposed officer misconduct in the early 2000s. For twenty years, OPD’s progress has been measured in compliance reports and federal reviews. A federal indictment charging two of its own helicopter pilots with fraud, and a former FAA examiner with enabling them, hands that hearing a headline nobody can spin.

The charges also reach back into a hard truth about the air unit: it is the department’s most trusted set of eyes. When the unit’s own paperwork is charged as fraudulent, every defense attorney in Alameda County gets a fresh cross-examination exhibit for cases that used aerial video as evidence. And the obstruction allegation — altering records after the fact — is the kind of count that turns a paperwork case into an integrity case, because it suggests someone knew the tests were fake and chose to make the paper match the story.

For the pilots themselves, the certifications at the center of the case are now evidence. The FAA can pull, retest and void certificates independent of the criminal case, which means even an acquittal would not automatically restore what the indictment says was never earned. The agency that certifies pilots has its own process, its own timeline, and no obligation to wait for a jury.

The case now runs on the federal clock, which is slower than the news cycle and immune to it. Grand jury indictments are followed by discovery, motion practice and — eventually — trial dates, typically a year or more out in the Northern District of California. By then the oversight hearing will have come and gone, the compliance reports will have been filed, and the question a federal judge will weigh is simpler than the headlines: whether a department can supervise itself, when the part of itself that flies the helicopter was certified by paperwork prosecutors call fake.

Arraignment details beyond the not-guilty pleas were not immediately available. A spinning-up story of this kind typically moves through a detention-and-release hearing next, then arraignment on the full indictment, with a trial date set months out.

An indictment is an accusation. All three defendants are presumed innocent, and the charges must be proven in court beyond a reasonable doubt.
